DESCRIPTION
Croatia Photo Tour is a specialized service offering photography tours guided by professional photographers, on locations in Croatia and neighboring countries. The official website of the service is www.croatiaphototour.com. The service is owned and operated by the IN, obrt za fotografske i druge usluge company (from here onward referred to as “the Company”), based in Zagreb. This document will be referred to from here onward as “Terms of Service”.
BOOKING
Bookings for tours and services are done via the www.croatiaphototour.com website and communicated with management in written form. Inquiries made in person or via telephone call are welcome, but bookings are confirmed only in written form, such as email.
You understand that each activity has a maximum number of participants and that certain dates or times may not be available. Therefore, booking as far in advance as possible is recommended.
PAYMENT
Payment for tours and services is due on various deadlines ahead of the tour, depending on the specific activity. Payment is due in Croatian kuna or other accepted currencies, such as euro or United States dollars. Payment is transferred to the Company bank account, communicated to you in confirmation emails.
CANCELLATION FEES
Advance payment of all or a portion of declared tour fees may be requested. In case of cancellation from your side, the Company will refund all moneys that have not been spent on costs of tour preparation, i.e. bookings, tickets and other costs associated with the tour itinerary.
INSURANCE
Although our trips and the region are safe, we still recommend purchasing travel and medical insurance, just as you should for any trip.
CLAIMS
Any claim has to be communicated in written form to our company during the stay or within a maximum of 15 days after the end of any arrangement with the Company. No claim will be accepted afterwards. All claims should be sent to the email igor@croatiaphototour.com.
LEGAL
JURISDICTION
Negotiation is considered a general method of solving problems or discrepancies concerning the fulfilment of a contract. In case the results of such negotiations are not found satisfactory by either party, the Commercial Court in Zagreb is considered relevant for appeal and arbitration.
PRIVACY STATEMENT
The Company respect your privacy and your personal information will be used only for the correspondence with you and for the needs of the tour. Any associates of the Company will not provide your personal data to third parties.
Personal data collected – the Company collects your first name, last name, country of origin, email address and phone number in order to be able to communicate with you directly. If you contact the Company, but do not book any services, your personal data will not be used for any other purpose. The stored personal data may be used to contact you subsequently, and if you choose to opt out of any further communication, you may state so to the Company directly or via a provided link, if possible. Your personal data will then be completely deleted from our files. At any point, you may request to see any and all personal data we have stored about you via the email igor@croatiaphototour.com.
Visual personal data – visuals taken of you while on tour may be used in the promotion of our services on our website and associated social media. If you object to such use, please state so to the Company in written form. You may also state so to the guide or any associate of the Company verbally during a tour, and any representative of the Company will do their utmost to respect your wishes.
Apart from our own website www.croatiaphototour.com, the Company operates social media accounts on Facebook and Instagram, and may use images of your person to showcase the types of tours we offer in various types of posts. These posts may include your first name and your country of origin, but nothing beyond that. However, other users of social media may share or repost such images using the legal tools provided by such applications. Visuals of you are stored on local computers as well as online cloud data storage providers, which are GDPR compliant.
The Company will not provide images of you directly to any third-party without your consent.
THIRD PARTY SERVICES
By using our services, you understand that we sometimes rely upon third-party tour organizers, transportation providers, hotel operators and food providers to provide services. All tickets, coupons, reservations, etc. are subject to the terms and conditions and other policies of the third-party service provider. We cannot control the actions of such third-parties and do not assume responsibility for unanticipated events that may occur, including, without limitation, travel delays, lost luggage, cancellations, overbooking, and other reservation errors. You should build some flexibility into your schedule in case we need to extend the length of a tour or service or make other reasonable scheduling changes to accommodate unanticipated events such as travel delays, lost luggage, cancellations, overbooking and other reservation errors that are not our responsibility. You will not be entitled to a refund from us in the event of unanticipated events that we are not responsible for. You further agree to hold us harmless from and against any liability for injury, death, damage, loss, accident, delay or irregularity that might occur in connection with any services provided by third parties.
LIABILITY
By attending one of our tours you are accepting certain risks. Joining a tour shall serve as an agreement for the release of our liability and a complete assumption of all risks by you and your heirs, administrator, executor, successors, and assign for all family members. By accepting our terms of service, you are acknowledging that you are aware that travel, wherever it may be, and by whatever means, involves some inherent risk of injury, illness, death, loss, or damage to personal property, which may be caused by acts of nature, negligence or actions of others.
In consideration of, and as part of the payment for your participation in a program, workshop, excursion, expeditions, other activities, or any program that the Company, or their assigns, may be conducting, you are voluntarily releasing the Company, their employees, assigns, independent contractors, or anyone involved thereof, from any damages, liabilities, costs, injuries, whether mental or physical, known or unknown, and by participation you agree to assume all risks whether known or unknown. You acknowledge voluntarily that traveling to areas that may be remote, foreign, mountainous, wilderness, wild rivers, remote deserts, and may not be maintained to the standards you are accustomed to may involve certain additional risks, dangers, and inconveniences including, but not limited to, terrorism, forces of nature, wild animals, hotel accommodations, airplane, vehicles, trains, boats, roads, walkways, trails, and other means of conveyance or other unknown risks. You acknowledge that medical services and facilities may not be readily available during all or part of the trip, including medical care, presence of physicians, and medication. We assume no liability for medical care. We assume no liability for dietary requirements you may have.
In case of travel in a vehicle operated by a guide, manager or any associate of the Company, you are covered to the extent of the obligatory vehicle and personal injury insurance that covers any and all passengers in the vehicle. The terms of such insurance vary per vehicle and the Company cannot be held responsible in relation to such insurance.
Unless accompanied by a parent or legal guardian (and with our approval), you must be at least 18 to attend one of our tours. Your participation signifies your full understanding and agreement that you release and hold harmless the Company, its guides, managers, officers, agents, sponsors, associates, sub-contractors, from any and all liability, actions, causes of actions, claims, debts, and demands of every kind whatsoever, known or unknown which may arise in connection with your participation in any activities arranged by them without limitation, all liability, actions, causes of action, claims, debts, and demands related to the negligence of said persons. Any associate of the Company will strive to provide the fastest and nearest medical aid if necessary, but cannot be held liable for providing or not providing such assistance.
You assume the responsibility to select an activity appropriate to your physical abilities and interests. You are personally responsible for being in sufficiently good health to undertake the activity. By accepting our Terms of Service, and by your deposit, you certify that you do not knowingly have any physical or other considerations of disability that would create a risk for you or other participants. In addition, you authorize the Company and/or its tour leader, to initiate and offer medical care in the event of a medical emergency. We reserve the right to request a doctor’s statement of good health.
You also acknowledge that you understand that travel with a group invariably involves compromise to accommodate the diverse desires, travel goals, personalities, and physical abilities of group members. You also understand that while itineraries are carefully planned, they are not a guaranteed schedule of activities, events, or participation, but only a guideline and example. Group participants must allow for flexibility and changes deemed necessary by the program leader or professional guides. There may be situations beyond our control due to geographic, climatic, physical or governmental restrictions that will cause further changes in timing, locations, and activities. Understanding this, you further agree that there will be no discounts or refunds for activities curtailed or otherwise affected by such circumstances.
You will be responsible for studying all pre-trip information; for bringing all equipment, personal items, and appropriate clothing; for conforming to standards of dress and hygiene; and for acting in a manner considerate of fellow participants, locations and environments, models, and locations. We reserve the right to cancel any activity and to accept or reject any person as a member of any activity. The program, workshop, expedition, excursion, or tour leader’s judgment shall provide the ultimate determination of an individual’s ability to participate in, or continue to participate in, any activity or program.
